We collect and process personal data only to the extent necessary to operate our website, manage bookings and guest enquiries, and meet our legal obligations. Every processing activity is based on one of the legal grounds set out in Art. 6(1) GDPR. We do not share data with third parties for advertising purposes and we do not use website tracking.

3.1 Visiting our website (server log files)

When you visit our website, our hosting provider automatically records technical data transmitted by your browser:

Legal basis: Art. 6(1)(f) GDPR – our legitimate interest in the error-free operation of the website

Retention period: 7 days, then automatically deleted

 

3.2 Contact by email, phone or WhatsApp

If you contact us by email, phone or WhatsApp, we process the data you provide (name, contact details, message content) solely to handle your enquiry. If a booking is made, the data will be further processed to fulfil the contract.

Retention period: Enquiries without a booking: 6 months; booking records and correspondence with tax relevance: 10 years (§ 147 German Fiscal Code / AO)

 

3.3 Booking data and mandatory guest registration

To carry out the rental agreement and meet our statutory registration obligation, we collect the following data from all travellers:

      First and last name and date of birth

      Home address (of the booking person)

      Passport number (for guests without a German residential address, in accordance with the Baden-Württemberg Accommodation Registration Act / LBeherbG BW)

      Photo or video of identity document (for the contactless online check-in)

 

The collection of registration data and the completion of the guest registration form are required by the statutory accommodation registration obligation and the local visitor’s tax (Kurtaxe) regulations of the health resort Seelbach.

3.4 Booking platforms (Booking.com, Airbnb)

We are listed on the booking platforms Booking.com and Airbnb. Bookings made through these platforms are governed by their own privacy policies. We receive from these platforms only the guest data strictly necessary to process your booking.

 

4. Third-party Servic


4.1 Website hosting (Duda)

Our website is hosted by Duda Inc., 560 S California Ave Suite 200, Palo Alto, CA 94306, USA. Technical data (in particular IP address and access times) are processed on Duda2019s servers on every page visit. A data processing agreement under Art. 28 GDPR is in place with Duda. Transfers of data to the USA are safeguarded by Standard Contractual Clauses under Art. 46(2)(c) GDPR.

4.2 Booking management (Smoobu)

We use Smoobu, a property management and guest communication platform provided by Smoobu GmbH, Zossener Str. 55–58, 10961 Berlin, Germany. Smoobu processes booking and guest data solely on our behalf; a data processing agreement under Art. 28 GDPR is in place. Data processing takes place on servers within the EU.

4.3 Instagram

Our website contains a link to the Instagram profile @villaschwarzwaldblick. Clicking this link takes you away from our website; the privacy policy of Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Ireland then applies. We do not embed Instagram content directly; data is transmitted to Meta only when you actively click the link.

4.4 Virtual tours (AWS S3, Frankfurt)

The 360° virtual tours of our holiday apartments are served via Amazon Web Services S3 (region eu-central-1, Frankfurt data center). Your IP address may be processed as part of the technical transmission. All data is stored exclusively on EU servers.

4.5 WhatsApp

We offer the option to contact us via WhatsApp (Meta Platforms Ireland Limited). When you use WhatsApp, Meta2019s privacy policy applies. For sensitive inquiries, we recommend using email instead.

6. Transfers to Third Countries

Where the services described above transfer data to countries outside the European Economic Area (EEA) – in particular the USA (Duda, Google Analytics) – such transfers are based on Standard Contractual Clauses under Art. 46(2)(c) GDPR and/or a valid adequacy decision of the European Commission (EU–US Data Privacy Framework).

      Portability Art. 20 – Data portability: you may request a copy of your data in a common, machine-readable format.

      Objection Art. 21 – Right to object: you may object to processing based on legitimate interests. We will then cease processing unless we can demonstrate compelling legitimate grounds that override your interests.

      Withdrawal Art. 7(3) – Right to withdraw consent: where processing is based on your consent (e.g. Google Analytics), you may withdraw it at any time with effect for the future.
